PRENUPTIAL AGREEMENTS

Getting married is one of the happiest moments in anyone’s life. However, people forget that part of planning for the upcoming wedding should include a premarital agreement / prenuptial agreement or what everyone calls a “Prenup”. The ever-dreaded prenup has dragged a negative stigma with it for years and is still thought by many to be only appropriate for the rich and famous. Times have changed! A rise in entrepreneurship, higher salaries, access to investment opportunities, and people getting married later in life has opened the eyes of many to the need for a prenup when getting married. 

Prenuptial agreements can be as complex or as simple as possible; it is not an all or nothing agreement. Many individuals simply wish to protect the business they have worked so hard to grow from the ground up or simply to protect investments or retirement accounts. Also, many times it is the lovely couples’ family who wishes the soon to be newlyweds to get a prenup to protect the family’s assets.

     

In Florida, Prenuptial Agreements require strict guidelines to be followed during the drafting and signing process; failure to follow these could result in an invalid Agreement should a divorce ever happen. It is important to get the assistance of experienced counsel who will ensure that all requirements are followed so you are truly protected.

POSTNUPTIAL AGREEMENTS

Post-Marital or Post-Nuptial Agreements (aka “Post-Nup”) is pretty much the same as a Prenup however instead of being drafted and signed before the marriage the parties to the Postnup are already married.

 

Postnuptial agreements tend to come up when one of the spouses begins a new business venture and must separate the business from the marital estate or when a large inheritance is received by one spouse. 

Whatever the reason for the PostNup, Florida requires strict guidelines to be followed during the drafting and signing process; failure to follow these could result in an invalid Agreement should a divorce ever happen. It is important to get the assistance of experienced counsel who will ensure that all requirements are followed so you are truly protected.

Surrogacy and Sperm Donor Agreements are the essential contracts that protect the future parent(s) and the surrogate or donor. These agreements detail the relationship between the parties during the process of conception, pregnancy, birth, and the connection, if any, of the surrogate or donor to the child.
